You're out of time! The Statute of Limitations

Have you ever heard of the Defense of Limitations?

For most crimes and civil lawsuits, there is a deadline in the law, known as the Statute of Limitations, for the criminal charge or civil lawsuit to be filed.

However, because the Defense of Limitations is an affirmative defense, then it is upon the Defendant to plead and prove that the time has already passed.
Failure to raise this defense can lead to it being waived.
