Have you heard of the Spousal Privilege?
Spousal Privilege protects certain communications between spouses from being disclosed in court.
It comes in two main forms: 1) the testimonial privilege, which allows one spouse to refuse to testify against the other spouse in criminal cases, and 2) the communications privilege, which protects private conversations made during the marriage.
The purpose is to preserve marital harmony and trust. However, exceptions apply—such as when one spouse is accused of a crime against the other or when there are allegations of child abuse.
However, this privilege ONLY applies to communications made DURING the marriage, though the privilege can last LONGER than the marriage.
