According to Section 1 of the 14th Amendment, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."
So The whole thing about us having three branches that check and balance each other, to prevent a dictator from happening, just isn't a thing anymore huh?
If the constitution doesn’t give you birthright citizenship, then it never did and would effectively mean that only nationalised citizens and descendants of naturalised citizens are in fact US citizens. The naturalisation process came into life in 1790, meaning any person who was born prior to that date was definitely not a US citizen- and in extension their descendants. And even after 1790 most arrived did not seek naturalisation, but were merely content their children were citizens. That would leave most US people without citizenship. It should probably be noted that without birthright citizenship, at least 4 of Trumps 5 children would not be citizens as their mothers were not citizens at their time of birth.

The entire point of an injunction is to prevent irreparable harm from taking place why wouldnt judges be able to do this? Especially in situations where people are going to be forced from the country or arrested while the litigation moves.
I'm less concerned with whether federal judges should have the power to uphold the law, than whether the president should be able to ignore the law entirely without consequence
So my understanding is that their trying to pass an UNCONSTITUTIONAL bill BEFORE they get to argue whether or not it's UNCONSTITUTIONAL to begin with.
The leaders of the judicial branch voting to decide if the judicial branch should be allowed to do it's job is crazy

I feel that removing birthright citizenship is stupid and dumb, not only cause it was built into our constitutional rights but also it can lead to them leaning the term of what a "citizen" is

The judicial branch is doing its job! Judge rules this isn’t legal, so it’s stopped until it gets appealed. It gets appealed all the way up to the Supreme Court, who is the final say on whether or not it’s legal.
This so stupid unless you are a native Indian decedent there is a very good chance you are an immigrant. I know my Great Great Grandparents were born here and that was late 1890s . Don’t know before that.
Basically, what this means is if the court sides with führer trump, then if the executive violates your constitutional rights, the checks and balances don't exist to stop it. Each induvidual person whose rights were violated would have to sue the government individually. Which costs hundreds of thousands of dollars and takes a long time, and then, that ruling wouldnt apply to the exact same case for the next person. If the court side with the führer here then the law no longer matters. The people have no real protection from abuses of power and the legal apparatus of the country ceases to funtion. And the fact that supreme court justices are even considering any aspect of this case futher than, "the constitution is a valid document, courts serve as a check and balance on fhe executive power" is insane. The fact that any of them are even considering middle ground between "the legal system of this country is a thing that exists" and "führer trump has supreme power to violate the rights of everyone everywhere" proves that this country is broken and nigh on impossible to ever repair. There must be massive reconstruction. This vile conservative movement must be diminished through real social programs that help everyone. So that the idea of removing them is faces with such outrage that conservativism cannot exist.
If they get rid of birthright citizenship, you could argue that anyone not Indigenous is no longer a citizen as not all previous relatives were born in the US. That would include Trump himself
