I used to love Sierra Mist. I never knew why they changed it to Starry, and now nonody buys it at my store. Hell we even had coupons first few months that we started selling it, and nobody bought it.

Looking at the TM info, Pepsi still holds the rights to the name. It never lapsed and in fact was re applied in 2017. Looking at the tadr website for Sierra Mist will show there were no proceedings or legal issues that came of this trademark. I think that Pepsi won't make a statement because this is all public information that can be found pretty easily.
My old school’s concession stand sold Sierra Mist for years, it only ever sold okay. The moment they switched to Starry, the remaining Mists sold in days.

This story is actually not true. No letters were sent, there wasn’t any conflict. Cierra just wanted to stir up fake drama to seem more interesting and gain notoriety while Sierra Mist just happened to be phased out. Also, trademarks are specifically for a certain area of products and services. Trademarking Sierra Mist in the food and beverages category would not give them the right to pursue anyone using a similar name in the adult video industry and viceversa. Please stop spreading misinformation.
They also reformulated it. Sierra Mist tasted better than Starry, but Sprite tastes better than either!
As much as I love your content, Mike, this case isn't a case, it's just a rumour that the content creator started. The U.S. Patent and Trademark Office records indicate that PepsiCo's trademark for Sierra Mist remains active and has not lapsed.
Everyone forgetting about the brief period of time where we had Mist Twist. Mist Twist I believe was identical in formula, but Starry had a distinctly different one from Sierra Mist.
Im actually surprised that as a lawyer you released this video without proper research. This entire story is an urban legend that this TikToker created 😂 This person is also known for creating false stories all the time. PepsiCo still holds the trademark for the name according to the U.S. Patent and Trademark Office website which is listed as “active” and a simple search would prove that. Honestly I feel like this entire story was created by PepsiCo to promote Starry because who even heard of that beverage before this controversy?

It was very sad. The last large brand American soda that used cane sugar. I stopped drinking soda after Sierra Mist was pulled.

Completely wrong. This guy is the equivalent of a facebook lawyer. Pepsi continues to hold the trademarks of sierra mist even today. This story doesen't even have anything to do with the discontinuation of sierra mist. The only reason their brand is gone is because of what they would call 'a strategic move to revitalize its presence in the lemon-lime soda market and better compete with dominant brands like Sprite.'

That is not a true story. FYI. It is something she made up about them getting rid of Sierra Mist. It has been thoroughly debunked. EDIT - Though with tonation, it came of as snark, I meant no hateful attitude toward this man at all. Just pointing that out for those who need to know. I have no idea whether he knows that isn't factual or not, and honestly, I think that is was meant to be a retelling of a viral story that thousands of people have told without giving the full truth. He is no different and doesn't need to be chastised. He is not on here lying about climate change or peddling a cure for cancer that can hurt you. He generally has helpful shorts as far as I have come across or at the very least, entertaining. Of course everyone should fact check everything but that is a little easier said than done. Myself and everyone here has mistakenly misrepresented something and this was no different. It was an entertaining short and the story would be great if true. Although I am sure he would be the first to advocate for fact checking, it is okay when someone gets something a tiny bit wrong. He wasn't slapping your mother.
